Nonprofit Law Blog: Attorney For Nonprofits

I often get asked about my work, especially by young law students and lawyers, but also by others looking for a meaningful profession. Some are attracted by what they perceive to be the money and respect associated with being an attorney combined with the social good (or saving grace) associated with working for nonprofits. Others look to position themselves to be able to effect change in a particular area (e.g., social justice, women?s rights, environment, education).

When asked what led me to this work, I start by pointing to a singular event: laying off all my coworkers at large branch of a global retailer where I was the operations manager. This made me rethink and ultimately reject the familiar platitude ?work to live, don?t live to work.? I wanted to find a job that was meaningful and an expression of my identity. Having been blessed with circumstances that allowed me to pursue this goal, two graduate degrees and several jobs later, I started my law practice focused on serving nonprofit organizations on January 1, 2005.

So, what does an attorney for nonprofits do? I certainly can?t speak for all of my peers whose practices vary widely, but I represent mostly 501(c)(3) charitable organizations on corporate and tax matters. On a given day, I may work on matters for 5-10 clients, doing things like counseling executives through compliance issues, reviewing or drafting governance documents and contracts, preparing tax-exemption applications, structuring mergers and collaborations, advising on operational issues and strategies, and working though earned income ? unrelated business issues. The missions of our clients vary widely: education, social justice, health, environment, arts, religion, international poverty relief, social services, children, animal welfare, scientific research, disaster relief, etc. So, while I may regularly work on certain types of matters repetitively (e.g., reviewing bylaws), there are always unique situations and interesting people to work with, and my expertise grows with each client. Because we regularly work with the 90% of nonprofits that are smaller or medium-sized organizations without in-house counsel, its also means a lot of teaching, which I love.

Apart from client work, I also find it very rewarding to write and present to audiences on a wide variety of legal issues affecting nonprofits and social enterprises and to teach nonprofit law at a local university. These activities also keep me sharp as they require that I continually read, attend seminars and conferences, and learn about my practice area and trends affecting the sector. They also allow me to be creative as I pursue my passion of finding how to engage audiences in unique, effective and fun ways. Providing pro bono counsel, serving on boards, and performing other community services further enrich my professional life.

On top of all of this, I must of course run a business and think about finances, employees, marketing, and an array of other matters every small business owner must manage. While it?s great to be in control of my business and career, managing is also the most challenging part of my job and why I sometimes entertain the thought of combining with another practice and giving up that role. For now, that's an unlikely prospect because I value the ability to create a unique work environment that emphasizes professional and personal growth equally with client service (and above profit maximization) in a manner that may not possible in another firm. When those conditions are matched with an amazing person, I know first-hand wonderful things are possible (thank you, Emily). I believe in the values of a B Corporation and am proud to be a member of the social business community.

As satisfying as I find my job, there are drawbacks to working in a very small firm, which some will find more significant than others. The collegial and team-oriented atmosphere of working in a more populated workplace with common goals is missing. Also, we do not regularly engage in cutting-edge research and advocacy on what may or may not be permissible under the law, which big firm attorneys with large institutional clients may find is a satisfying part of their practice. In addition, as outside counsel, we are removed from more directly experiencing the ultimate impact of our work.

For me, the drawbacks are minor compared to the benefits of being able to (i) shape our firm and the ways we serve our clients and our community, (ii) determine the nature of my job and workday, and (iii) develop more meaningful relationships with my coworkers. And because I trust that we know how to work to bring value to our clients and strengthen their abilities to make the world a better place, providing counsel to many clients serving in a variety of ways is, for me, even more rewarding than working for a single organization. It also frees me up to write, speak, teach, and reach out to other organizations and individuals in ways that otherwise might not be possible. Most importantly, working within a small firm allows me to provide these same opportunities to my coworkers.

John Mallinger leads Frys.com Open

SAN MARTIN, Calif. (AP) ? John Mallinger remained in position for his first PGA Tour victory, shooting a 1-under 70 on Saturday in the Frys.com Open to take a two-stroke lead into the final round.

The 33-year-old Mallinger had a 15-under 198 total at CordeValle after opening with a 66 and matching the course record with a 62 on Friday.

"I just didn't have it all. I didn't drive it as well as I did yesterday," Mallinger said. "I think I hit every fairway yesterday, and then today I just got off to a weird start. But I hung around there and made some birdies on the back nine that got me back into position. Still got lead, still got a good spot, and look forward to tomorrow."

He has finished second twice in his seven-year career on the tour, losing in a playoff to Bo Van Pelt in Milwaukee in 2009. Mallinger had the third-round lead for the second time in his career. He shared the lead at the 2009 Byron Nelson Championship and ended up tying for sixth.

"I'm going to still stay aggressive and try to make as many birdies as possible," Mallinger said. "It's going to be a birdie day. I mean, it's supposed to be nice tomorrow."

Sweden's Jonas Blixt was second after a 66. He birdied five of the last eight holes.

"The front nine is a little harder," said Blixt, coming off a third-place finish last week in Las Vegas. "The back nine you can make a couple birdies. Hopefully, I can finish like I did today.

He had a simple game plan for Sunday.

"Make birdies," Blixt said.

Charles Howell III and Jason Kokrak were 12 under. Howell had a 66, and Kokrak shot 67.

"It'll be a shootout tomorrow," Howell said. "The greens are so soft and there will be a lot of birdies, but at least I have a chance."

He won the last of two tour titles in 2007.

Kokrak is in his first year on the tour after winning twice late last year on the Web.com Tour.

"This is the first time I put myself in really good position," Kokrak said. "I just want to go out tomorrow and do the same things I did today."

At 167th on the money list, he's in danger of losing his tour card.

Vijay Singh and Brazil's Alexandre Rocha were 11 under. They shot 66.

The 49-year-old Singh won the last of his 34 PGA Tour titles in 2008. He birdied Nos. 15 and 16, eagled the short par-4 17th and closed with a par.

"I found something in my putting that's working really, really good, so hopefully tomorrow I can get some going," Singh said. "I've changed my grip a little bit and it's flowing really freely. So that's a big plus."

British Open champion Ernie Els was 5 under after a 69.

'Taken 2' takes down 'Argo' in close weekend

(AP) ? Liam Neeson's "Taken 2" has defended its box-office title with a narrow win over Ben Affleck's "Argo."

Sunday studio estimates put 20th Century Fox's action sequel "Taken 2" at No. 1 with $22.5 million in its second weekend. "Taken 2" raised its domestic total to $86.8 million.

Affleck's "Argo," an Iranian hostage thriller from Warner Bros., opened in second-place with $20.1 million.

Ethan Hawke's "Sinister," about a true-crime writer caught up in supernatural horror, debuted at No. 3 with $18.3 million. The movie was released by Lionsgate's Summit Entertainment banner.

Sony's "Here Comes the Boom," with Kevin James as a teacher who becomes a mixed martial arts sensation, started weakly at No. 5 with $12 million.

The weekend's other new wide release, CBS Films' crime comedy "Seven Psychopaths," also opened to small crowds, taking in $4.3 million to finish at No. 9. The movie's ensemble cast includes Colin Farrell, Sam Rockwell, Christopher Walken and Woody Harrelson.

The follow-up to "Taken," the hit that established dramatic star Neeson as an action hero, "Taken 2" was dinged by critics who called it a replay of the original. The sequel has Neeson's ex-CIA guy up against a gang of Albanian goons out for revenge for their kin that he killed in the first movie.

"It kind of proves that reviews do not matter," said Paul Dergarabedian, an analyst for box-office tracker Hollywood.com. "Audiences just continue to eat this up. They just love Liam Neeson in this role."

"Argo" may prove the opposite, using its great reviews and Academy Awards buzz to settle in for a long stay at the box office. Affleck directed and starred in the real-life story about a CIA operative who concocts a plan to rescue six Americans hiding in Tehran after the 1979 U.S. embassy takeover by disguising them as members of a fake movie crew.

Revenues on the film ticked up a whopping 47 percent from opening day Friday to Saturday, a sign that audiences were talking it up exuberantly to friends.

"This is a really good indication of how quickly word of mouth can spread," said Dan Fellman, head of distribution at Warner Bros. "The critical acclaim in this case is going to translate into commercial success."

"Argo" played almost entirely to older crowds that do not necessarily rush out to see movies over opening weekend but often check out well-reviewed films in subsequent weeks.

Lionsgate was happy to come in third with "Sinister," ''especially given most people's projections on the film were in the low teens at best," said David Spitz, head of distribution. "It's always nice to come in and over-perform everybody's expectations."

Hollywood's business continues to grow as it heads into the busy holiday season. Overall domestic revenues came in at $132 million, up 51 percent from the same weekend last year, when "Real Steel" led with $16.3 million.

Estimated ticket sales for Friday through Sunday at U.S. and Canadian theaters, according to Hollywood.com. Where available, latest international numbers are also included. Final domestic figures will be released Monday.

Egypt's liberals, Islamists clash, 110 reported injured

CAIRO (Reuters) - Opponents and supporters of Egyptian President Mohamed Mursi clashed in Cairo on Friday in the first street violence between rival factions since the Islamist leader took office.

Islamists and their opponents threw stones, bottles and petrol bombs, and some fought hand-to-hand, showing how feelings still run high between the rival groups trying to shape the new Egypt after decades of autocracy, although the streets have generally been calmer since Mursi's election in June.

The Health Ministry said 110 people had sustained light to moderate injuries, state media reported.

A government is in place, but Islamists and liberals are at loggerheads over the drafting of the new constitution, which must be agreed before a new parliament can be elected.

Many of the thousands who gathered in Tahrir Square were angry at this week's court ruling that acquitted former officials charged with ordering a camel-and-horseback charge on protesters in the uprising that ousted Hosni Mubarak last year.

But even before that ruling, Mursi's opponents had called for protests against what they say is his failure to deliver on his promises for his first 100 days in office.

"Down, down with rule by the guide!" Mursi's opponents chanted, suggesting that Muslim Brotherhood leader Mohamed Badie pulls the strings even though Mursi officially quit the Brotherhood on taking office.

"Mursi! Mursi!" the president's backers responded.

Late on Friday, a statement issued by the cabinet condemned the events saying they hinder the government's political and economic efforts. It said Prime Minister Hisham Kandil "calls on all parties present in Tahrir Square and the other squares and places to stay away from any action that would tarnish the image of new Egypt".

BUSES SET ON FIRE

Some demonstrators pulled down a temporary podium that had been erected on a side of the square for speeches. Later, Islamists took over the square, triggering scuffles in nearby streets as they tried to keep rival groups out.

Two buses parked near the square were set alight. Witnesses said they had been used by the Brotherhood to bring in supporters.

The Brotherhood's Freedom and Justice Party (FJP) in a statement expressed its "sorrow" over what happened to the buses it said were used to bring members to Cairo. It also condemned an attack on the Brotherhood's headquarters in the industrial city of El-Mahalla El-Kubra.

"We went to protest against the constituent assembly and Mursi's failure in his 100 days, and Islamists prevented us and are now controlling the square," said Islam Wagdy, 19, a member of a group set up by leftist politician Hamdeen Sabahy.

An FJP spokesman denied this. "What happened today was an attempt by the liberal powers ... to prevent Islamists expressing their views and protesting in Tahrir, which belongs to all Egyptians and not to a certain current," Ahmed Sobeih said.

There was no intervention by police, who have often been the target of protesters' anger because of their brutality against demonstrators in last year's revolt.

The Brotherhood, which joined Friday's protest, had said it should focus on this week's court ruling.

The charge by men on camels and horseback was one of the most violent incidents of the uprising that ousted Mubarak in February 2011. The case has been closely watched by those seeking justice for the hundreds killed in the revolt.

The court acquitted top Mubarak-era officials such as former lower house speaker Fathi Sorour and Mubarak aide Safwat Sherif, both of whom are scorned by many Egyptians.

ALEXANDRIA

Demonstrators also gathered in Egypt's second city, Alexandria, where Mursi went to a mosque to perform Friday prayers before giving a speech.

"We won't let anyone involved in corruption get away," he said, while urging protesters not to disrupt workers. As he spoke, some chanted: "The people want the judiciary purged."

Many blame the general prosecutor, perceived as a Mubarak loyalist, for not securing convictions.

In an apparent bid to appease the public, the president had said late on Thursday he was moving Abdel Maguid Mahmoud out of that position to make him ambassador to the Vatican, because Egyptian law prevented him being dismissed.

Mahmoud denounced the move and told Egyptian media he would stay on. The influential judges' club condemned the decision as interference and called for a meeting of judicial officials on Sunday to discuss action, the state news agency reported.

Even some political groups who wanted Mahmoud out questioned the way Mursi had done it. The liberal Free Egyptians Party said changing the prosecutor should be an independent judicial move.

Mursi has won grudging respect from some opponents for pushing the army out of politics, after decades of rule by military men, and for raising Egypt's profile abroad.

But many Egyptians, with high expectations after the revolt, say he has not done enough at home, failing to deliver on promises for his first 100 days such as cleaning up cities and getting traffic moving in Egypt's congested streets.

Many more secular-minded Egyptians and minority Christians also worry that Mursi and his Islamist supporters will seek to impose religious restrictions on society.

FDA regulation of pharmacies has knotty history

(AP) ? The deadly meningitis outbreak linked to contaminated pain injections has prompted calls for tighter federal regulation of compounding pharmacies, which have periodically been blamed for crippling and sometimes fatal injuries. But this isn't the first time Congress has pushed for more authority over the industry.

Such efforts stretch back to the 1990s, and after vigorous pushback by compounding pharmacists, they have left a patchwork of incomplete, overlapping laws, contradictory court rulings and overall uncertainty about how much power the Food and Drug Administration has to regulate compounders.

And with a gridlocked Congress at its most unproductive in decades, experts don't expect to see new laws passed anytime soon.

The issue flared up in the past several days after the New England Compounding Center of Framingham, Mass., came under suspicion as the source of the tainted steroid shots that have sickened at least 184 people in 12 states, causing 14 deaths.

Several members of Congress this week promised to introduce legislation giving the FDA greater authority to oversee the specialty pharmacies, which custom-mix drugs for patients for everything from menopause symptoms to cancer. The compounding industry in the U.S. has grown into a $3 billion business with 7,500 pharmacies, according to its trade group.

"It's incredibly complicated to explain what our authority is and is not, and the nuances of that," Deborah Autor, FDA's deputy regulatory commissioner, said Thursday. She suggested the FDA would support new laws to oversee the industry.

"The world has changed a lot since the days of mortar and pestle, and this is the time for pharmacists, for lawmakers, for regulators and for doctors to sit down to grapple with this new model of pharmacy compounding," Autor said.

Compounding pharmacies are critical for patients who need solutions, creams and other medicines customized for, say, smaller dosages or to remove ingredients that cause allergies. Unlike drugs that are manufactured for mass-market distribution, these products are not subject to premarket review by the FDA.

All pharmacies, including compounding pharmacies, have long been regulated by state pharmacy boards, many of which date back to the 19th century. At that time nearly all drugs dispensed in the U.S. were individually compounded by pharmacists. The law that created the FDA in 1938 gave the agency strict authority over drug manufacturers, which quickly eclipsed pharmacists as the main producers of prescription medicines.

For decades, the state-federal divide persisted, with states overseeing compounding pharmacies and the FDA policing drug manufacturers.

But in the 1990s, FDA regulators began to more closely scrutinize compounding pharmacies, as their number multiplied and some grew into big businesses. Instead of making individualized products based on a physician's prescription, companies began mass-producing products and promoting them broadly.

"When you get into that situation, pharmacy compounding can be a disguise for unregulated manufacturing," said Michael Labson, a food and drug attorney in Washington. Recent drug shortages caused by consolidation among drug manufacturers, among other factors, have only increased demand for compounded alternatives.

In recent years some compounding pharmacies have been blamed for outbreaks caused by contaminated medicines. Two people were blinded in Washington in 2005. Three died in Virginia in 2006 and three more in Oregon the following year. Twenty-one polo horses died in Florida in 2009. Earlier this year, 33 people in seven states developed fungal eye infections.

Compounding experts, including the president of the leading compounding pharmacy trade group, believe the New England Compounding Center crossed the line into full-scale manufacturing. Indeed, the FDA had warned the company in 2006 about compounding and distributing anesthetic "for general distribution" rather than for individual prescriptions.

FDA officials said they followed up with the company after sending the warning letter but did not re-inspect it.

"They assured us they were adequately protecting patients and complying with applicable laws and regulations," Autor said. "We took some action, but it's very complicated ? our ability to take action here."

A spokesman for New England Compounding Center had no comment.

FDA officials have repeatedly stressed the challenges the agency faces policing compounding operations. In fact, some former agency officials say that the FDA is hesitant to act after years of legal battles with lawyers and lobbyists for the industry.

The International Academy of Compounding Pharmacists has spent more than $1 million lobbying Congress in the past decade and has a track record of defeating measures opposed by the industry. A 2003 provision to set up an FDA advisory committee to oversee compounders was killed by then-House Majority Leader Tom Delay, who said it would create unnecessary federal interference. Delay represented Sugar Land, Texas, the headquarters of the compounding academy.

The group's president said Friday he would "absolutely" cooperate with the FDA and Congress on new laws to prevent outbreaks.

"The behavior and actions of this one particular business resulted in the deaths of people, and that is antithetical to what pharmacists do," David Miller said. "Whatever they were doing, we have to make sure it never happens again."

But he added that New England Compounding Center appeared to be acting as a manufacturer, which is "contrary to what a compounding pharmacy is all about."

Even when the FDA has succeeded in getting legislation through Congress, it has gotten tangled up in the courts. In 1997 Congress passed an FDA-supported law that allowed the agency to regulate compounding pharmacies if they overstep certain standards for drug production, labeling and advertising. Specifically, the law said that compounding pharmacies were subject to FDA oversight if they advertised their products.

A federal appeals court sided with pharmacists and ruled that this last requirement was unconstitutional, and the Supreme Court upheld the decision in 2002. But the court did not rule on whether the other requirements in the law should stand, creating a legal limbo for regulators. Since then, different appeals courts have issued conflicting judgments on the remainder of the law, which could wind up back at the Supreme Court.

Still, some former agency lawyers say new laws are not necessary when dealing with companies that have clearly crossed the line from compounding drugs to full-blown manufacturing.

"Legislation isn't necessary here," said Sheldon Bradshaw, former FDA chief counsel during the Bush administration and now an attorney in Washington. "FDA already has all the authority they need to go after the New England Compounding Centers of the world. I'm honestly shocked by how FDA is now downplaying its authority in this regard."

In eczema, immune T cells invade the skin and secrete factors that drive an allergic response, making the skin itch. Dr. Raif Geha, of Boston Children?s Hospital, and his collaborators now show that scratching the skin precipitates the condition by encouraging an influx of other immune cells called neutrophils. These neutrophils secrete a lipid called leukotriene B4 that calls in more neutrophils, and more importantly, potent immune T cells that are the hallmark of eczema. These cells cause inflammation that aggravates the skin further. The investigators suspected that blocking the onslaught of these cells might slow down the disease or even stop it in its tracks.

Furthermore, Dr. Geha and his colleagues wondered whether the production of leukotriene B4 served to recruit T cells to the site of mechanical insult. And indeed that was the case. ?We showed that a drug that blocks the production of leukotriene B4 blocks the development of allergic skin inflammation in a mouse model of eczema,? says Dr. Geha. His team also found that deleting the receptors on immune cells that bind to leukotriene B4 had a similar effect.

"Our findings suggest that neutrophils play a key role in allergic skin inflammation and that blockade of leukotriene B4 and its receptor might provide a new therapy for eczema,? says first author Dr. Michiko Oyoshi.

Dubbed ?Project94?, the partnership will allow organizations a chance to enhance their brand by bidding on 94 one and two character .org domains, including a.org, o.org, 7.org, and pj.org.

The partnership is a considerable win for both Go Daddy and eNom, giving them exclusive rights to auction the coveted domains. The two companies will divide the 94 domains, auctioning 42 domains a piece on behalf of PIR.

The domains are beneficial for organizations in that they offer a short and memorable domain name, which can be particularly crucial when it comes to attracting visitors to their respective websites.

Though these domain names were previously reserved to the public, they are now made available due to a recent registry amendment and plan that was approved by Internet governing body ICANN earlier this year.

Jay Cutler knows it looks like he doesn?t care for Mike Tice, but according to him, nothing could be further from the truth.

Cutler told Sean Jensen of the Chicago Sun-Times that Tice?s background as a player, and the versatility that gives him, bought him a level of respect that previous coaches might not have enjoyed.

?He gets it as a player; that?s the thing of it,? Cutler said. ?He knows what it?s like to be a player. He knows what it?s like to install, then get to the game, call a play and it not work.

?He puts a lot of ownership and accountability on the players because we?re the ones out there. He?s like, ?Hey, if you guys don?t like this, tell us you don?t like it and then let?s make a change and figure this out.? He?s really good about that.?

That looks like a thinly veiled shot at former offensive coordinator Mike Martz, who had a brilliant set of drawings and wanted to make sure the mere mortals running them didn?t mess them up.

?If I had to pick, if it was up to me, I would want control over and be able to do stuff and put in the best plays and be able to audible sometimes,? Cutler said. ?That?s the fun part of being a quarterback. Going up to the line and be like, ?All right.?

?It?s more of a mental game.?

Cutler insists he respected Martz, but that his former play-caller?s system wasn?t a fit for his personaltiy.

?He was just a different philosophy, a different mentality. He called his plays. And he was really good at it. He was amazing at it,? Cutler said. ?He would put you in positions, and he?d say, ?Hey, throw it here, in this coverage, and a lot of times it worked.?

?I just wasn?t built like that, I didn?t come up in the league like that, so it was a different system for me.?

The fact he can communicate openly with Tice helps, because it puts him back on the comfortable footing he had in Denver with Mike Shanahan. And he said that allows him to move past the sideline flap in Dallas, when cameras showed him walking away from Tice while he was talking.

?Even when everything happened in Dallas, and it got blown out of proportion, we were talking on the way home,? Cutler said. ?On the bus, he was like, ?This stuff is getting out of hand.? I said, ?I know. It is what it is.? We were cool then.

?If you?re a player in the NFL, there have been times when this stuff happens, where someone yells at a coach, walks away from a coach, curse at a coach, tells them they don?t know what they?re talking about. It happens. It was one of those things that happened, and they caught it on camera.

?But literally, 10 seconds later, he came over and I was like, ?We got to make that. We got some more stuff we can call.? And he said, ?I totally agree. Let?s go.? And we moved on.?

Cutler?s problem is largely one of perception. He often looks like a jerk when he stomps away from a coach, and acts like one many times, such as shoving and cursing at his linemen. But he?s playing good football, and if those around him can work around that, they?ll all benefit.

Clear Sky-2012 military exercise moves into active phase : Voice of ...

The drills started on the 5th of this month and have been under way in Kazakhstan, Tajikistan and Kyrgyzstan.

The troops are drilled in exchanging information about the air situation while preparing for and taking military action, and also in studying coordinated action when repelling the enemy?s destructive missile strikes, as well as strikes by conventional aircraft.

Russian planes involved in the exercise are interceptor- fighters MIG-31 and A-50 AWACS aircraft.

The Russian planes will operate out of the Kant Russian base in Kyrgyzstan. The drills are due over on October 16th .

LGBT Dilemma: Complications from Drug and Alcohol Abuse may ...

There are no real hard numbers for LGBT suicides rates, as it is not a common practice to label a deceased person with that designation. What we do have is research and studies indicating that upwards of 30 to 40% of LGBT adults have attempted suicide at least once in their lifetime.

These studies show a correlation between attempted suicide and drug and alcohol abuse, and the results are staggering.

Studies have found that 35% of lesbians had a history of excessive drinking, compared to only 5% of the heterosexual women in the sample (Saghir, 1970; Lewis, 1982). Approximately 30% of lesbians and gay men are addicted to drugs (Rofes, 1983). The facts show that the homosexual community constitutes a high-risk population with regard to alcoholism, drug addiction and dual diagnosis.

Why is drug addiction and alcohol addiction such a problem? It is important not to assume that homosexuality causes gay drug rehab or gay alcohol addiction. When gays, lesbians and bisexuals internalize society?s homophobic attitudes and beliefs, the results can be devastating. Society?s hatred becomes self-hatred. As a minority group; gays, lesbians and bisexuals are victims of systemic and ongoing oppression. It can lead to feelings of alienation, despair, low self-esteem, self-destructive behavior, and drug addiction (Nicoloff & Stiglitz, 1987).

Some gays, lesbians and bisexuals resort to drug abuse or alcohol abuse as a means to numb the feelings of being different, to relieve emotional pain or to reduce inhibitions about their sexual feelings. Drug abuse or alcohol abuse often begins in early adolescence when youth first begin to struggle with their sexual orientation. When surrounded by messages telling you are wrong and sick for who you are, eventually you begin to believe it.

Having to hide your identity and deal with homophobic comments and attitudes- often made by unknowing friends and family ? can have a profound effect on you. Lesbians and gay men are also 7 times more likely to be the victims of crimes than the average citizen (National Gay and Lesbian Task Force, 1984).

In response to this overwhelming oppression and homophobia, many lesbians, gay men, and bisexuals use alcohol and drugs to cope.

Homophobia in our society has limited the opportunities for gays and lesbians to meet each other safely. The gay bar culture emerged as a place to find other gays and lesbians without fear of harassment. The gay bar is a seductive institution. It is the most available place where people can explore being gay and socialize.

There is also a lack of alternative alcohol-free places and occasions to socialize within the gay community. This only intensifies the implied connection between drinking and socializing in gay and lesbian social circles.

For those gay addicts or gay alcoholics seeking drug rehab or alcohol rehab, there are gay drug rehabs, gay alcohol rehabs or drug rehabs with gay addiction treatment components where a gay or lesbian can expect to receive addiction treatment in a safe, gay friendly environment.

Suicide

More gays and lesbians have considered suicide an option than heterosexuals (Bell & Weinberg, 1978). Lesbian and gay youth are 2 to 6 times more likely to attempt suicide than other youth, and may account for 30% of all completed suicides among teens, although they account for only about 10% of teens (Cook, 1991). This in conjunction with a high incidence of drug use and alcohol abuse, would lead one to believe that dual diagnosis in the gay community is higher than that of the heterosexual community. Congress reveals details of second U.S. secret facility in Benghazi

WASHINGTON (Reuters) - A public clash in Congress on Wednesday over photographs depicting the location of a second, semi-secret U.S. facility in Benghazi, Libya put the spotlight on a compound said to be more secure than the public American mission where U.S. Ambassador Christopher Stevens died last month.

When State Department officials, describing the chain of events on the night Stevens and three others died in a terrorist attack, displayed commercial satellite images of the two U.S. facilities, Rep. Jason Chaffetz, a Utah Republican, sharply accused them of divulging classified material.

"I was told specifically while I was in Libya I could not and should not ever talk about what you're showing here today," Chaffetz said at a hearing of the House Committee on Oversight and Government Reform. A congressional aide confirmed he was referring to the second site.

The existence of the second compound has been widely reported in accounts of the September 11 violence in Benghazi, often being referred to as a "safe house" or "annex" to the temporary U.S. consulate. State Department officials at Wednesday's hearing said the photographs were not secret.

While the U.S. officials gave a fleeting public glimpse into the compound, they divulged little of substance on its purpose prior to the Benghazi attack, which has became an issue in the U.S. presidential campaign and the subject of multiple State Department and congressional probes.

Reuters, however, has learned some new details about it from U.S. officials, who spoke on condition of anonymity because of the issue's sensitivity and the ongoing official probes.

They described the second facility as a significant and largely secret complex, housing diplomatic and intelligence personnel. Among their assignments was a high-priority inter-agency program to locate shoulder-fired missiles and other weapons loosed by Libya's 2011 revolution. That program is coordinated by the State Department's Bureau of Political-Military Affairs.

The compound also housed a seven-man U.S. "quick-reaction security team" that went to the temporary consulate after Stevens and others came under attack there, according to testimony on Wednesday.

The two sites were about 1.2 miles (about two km) apart.

BETTER DEFENDED

Several U.S. officials, speaking on condition of anonymity, said the second compound, which contained several buildings, including residential quarters for U.S. personnel, was far better defended than the temporary consulate where Stevens and IT specialist Sean Smith died.

After the consulate was overrun in an attack that began at 9:40 pm local time, U.S. and Libyan personnel retreated by car to the second site, where they fought off not one, but two, more waves of assaults, officials said.

Charlene Lamb, a top official in the State Department's Bureau of Diplomatic Security, told lawmakers that shortly after those retreating from the temporary consulate arrived at the second site, "the annex itself began taking intermittent fire for a period of time."

In the early morning of September 12, after a backup U.S. security team arrived from Tripoli and went to the second site, "the annex started taking mortar fire, with as many as three direct hits on the compound," Lamb said.

Defenses at the second site largely held and unlike the temporary consulate, its grounds were not overrun. However, two U.S. security officials, Glen Doherty and Tyrone Woods, were killed there in what U.S. officials described as an unlucky mortar strike. The rest of the contingent eventually escaped to Benghazi's airport.

The assertions that the second site had relatively sophisticated defensive measures could raise additional questions about why the nearby consulate was not further reinforced given the volatile security environment in Benghazi.

Rex Ubben, whose son David was badly wounded in the attack on the second site and is being treated at Walter Reed National Military Medical Center, said his son had described an intense, sophisticated attack there.

The mortar fire's accuracy "indicates to me that someone was either very, very good, highly trained and skilled, or that the mortar was already set up and pointed at the 'safe house' and only minor adjustments were needed," Ubben, a 24-year Air Force veteran, told Reuters by email last week, relaying his son's account.

Secretary of State Hillary Clinton and other top U.S. officials have defended security measures in place at the temporary consulate, although those claims came under harsh attack by committee Republicans on Wednesday.

Officials investigating the attacks say there is evidence the State Department wanted to maintain a low security profile at the temporary consulate - which was the public face of the U.S. presence in the city - to project an appearance of normality in U.S. dealings with Libya.

Because Benghazi was regarded as lawless and violent, with a heavy presence of Islamic militants, the second compound's security measures included cameras and sensors and its security force included well-trained Americans like Doherty and Woods, the two former Navy SEALs who died in the mortar attack, the officials said.

Fish getting smaller as the oceans warm

ScienceDaily (Sep. 30, 2012) ? Changes in ocean and climate systems could lead to smaller fish, according to a new study led by fisheries scientists at the University of British Columbia.

The study, published September 30 in the journal Nature Climate Change, provides the first-ever global projection of the potential reduction in the maximum size of fish in a warmer and less-oxygenated ocean.

The researchers used computer modeling to study more than 600 species of fish from oceans around the world and found that the maximum body weight they can reach could decline by 14-20 per cent between years 2000 and 2050, with the tropics being one of the most impacted regions.

"We were surprised to see such a large decrease in fish size," says the study's lead author William Cheung, an assistant professor at the UBC Fisheries Centre. "Marine fish are generally known to respond to climate change through changing distribution and seasonality. But the unexpectedly big effect that climate change could have on body size suggests that we may be missing a big piece of the puzzle of understanding climate change effects in the ocean."

This is the first global-scale application of the idea that fish growth is limited by oxygen supply, which was pioneered more than 30 years ago by Daniel Pauly, principal investigator with UBC's Sea Around Us Project and the study's co-author.

"It's a constant challenge for fish to get enough oxygen from water to grow, and the situation gets worse as fish get bigger," explains Pauly. "A warmer and less-oxygenated ocean, as predicted under climate change, would make it more difficult for bigger fish to get enough oxygen, which means they will stop growing sooner."

This study highlights the need to curb greenhouse gas emissions and develop strategies to monitor and adapt to changes that we are already seeing, or we risk disruption of fisheries, food security and the way ocean ecosystems work.
