Reid says 2 sides still apart on 'fiscal cliff'

WASHINGTON (AP) ? Senate Majority Leader Harry Reid says the two sides are still apart as they race against a midnight deadline for resolving their differences over the "fiscal cliff."

The Nevada Democrat says negotiations are continuing. But he cautioned that bargainers are running out of time and still have differences over some issues, though he did not say what still divides them.

Reid's remarks came Monday morning after the two sides narrowed their differences during an evening of bargaining between Senate Minority Leader Mitch McConnell and Vice President Joe Biden.

Without agreement by midnight, wide-ranging tax increases and budget-wide spending cuts ? the so-called fiscal cliff ? will begin taking effect. Though the impact of those changes would be felt gradually, economists have warned that they could cause recession if left intact.

Report: State Dept. made 'grievous mistake' over Benghazi

WASHINGTON (Reuters) - The State Department made a "grievous mistake" in keeping the U.S. mission in Benghazi open despite inadequate security and increasingly alarming threat assessments in the weeks before a deadly attack by militants, a Senate committee said on Monday.

A report from the Senate Homeland Security Committee on the September 11 attacks on the U.S. mission and a nearby CIA annex, in which the U.S. ambassador to Libya and three other Americans died, faulted intelligence agencies for not focusing tightly enough on Libyan extremists.

It also faulted the State Department for waiting for specific warnings instead of improving security.

The committee's assessment, "Flashing Red: A Special Report On The Terrorist Attack At Benghazi," follows a scathing report by an independent State Department accountability review board that resulted in a top security official resigning and three others at the department being relieved of their duties.

Joseph Lieberman, an independent senator who chairs the committee, said that in thousands of documents it reviewed, there was no indication that Secretary of State Hillary Clinton had personally denied a request for extra funding or security for the Benghazi mission. He said key decisions were made by "midlevel managers" who have since been held accountable.

Republican Senator Susan Collins said it was likely that others needed to be held accountable, but that decision was best made by the Secretary of State, who has the best understanding "of how far up the chain of command the request for additional security went."

The attacks and the death of U.S. Ambassador Christopher Stevens put diplomatic security practices at posts in risky areas under scrutiny and raised questions about whether intelligence on militant activity in the region was adequate.

The Senate report said the lack of specific intelligence of an imminent threat in Benghazi "may reflect a failure" by intelligence agencies to focus closely enough on militant groups with weak or no operational ties to al Qaeda and its affiliates.

"With Osama bin Laden dead and core al Qaeda weakened, a new collection of violent Islamist extremist organizations and cells have emerged in the last two to three years," the report said. That trend has been seen in the "Arab Spring" countries undergoing political transition or military conflict, it said.

NEED FOR BETTER INTELLIGENCE

The report recommended that U.S. intelligence agencies "broaden and deepen their focus in Libya and beyond, on nascent violent Islamist extremist groups in the region that lack strong operational ties to core al Qaeda or its main affiliate groups."

Neither the Senate report nor the unclassified accountability review board report pinned blame for the Benghazi attack on a specific militant group. The FBI is investigating who was behind the assaults.

President Barack Obama, in an interview on NBC's "Meet the Press" on Sunday, said the United States had "very good leads" about who carried out the attacks. He did not provide details.

The Senate committee said the State Department should not have waited for specific warnings before acting on improving security in Benghazi.

It also said it was widely known that the post-revolution Libyan government was "incapable of performing its duty to protect U.S. diplomatic facilities and personnel," but the State Department failed to fill the security gap.

"Despite the inability of the Libyan government to fulfill its duties to secure the facility, the increasingly dangerous threat assessments, and a particularly vulnerable facility, the Department of State officials did not conclude the facility in Benghazi should be closed or temporarily shut down," the report said. "That was a grievous mistake."

The Senate panel reviewed changing comments made by the Obama administration after the attack, which led to a political firestorm in the run-up to the November presidential election and resulted in U.S. Ambassador to the United Nations Susan Rice withdrawing her name from consideration to replace Clinton, who is stepping down early next year.

Rice had said her initial comments that the attack grew out of a spontaneous protest over an anti-Islam film were based on talking points provided by intelligence agencies.

Lieberman said it was not the job of intelligence agencies to formulate unclassified talking points and they should decline such requests in the future.

The report said the original talking points included a line saying "we know" that individuals associated with al Qaeda or its affiliates participated in the attacks. But the final version had been changed to say: "There are indications that extremists participated," and the reference to al Qaeda and its affiliates was deleted.

The report said that while James Clapper, the director of national intelligence, had offered to provide the committee with a detailed chronology of how the talking points were written and evolved, this had still not been delivered to Capitol Hill because the administration had spent weeks "debating internally" whether or not it should turn over information considered "deliberative" to Congress.

A Baby Shower, Christmas, And Doctors Appointments Have Kept ...

My daughter, Emily

December 16 was a happy day. That?s when my daughter Emily, was honored with a baby shower for my new grandson, Parker, who is due to arrive on January 31. She received lots of cute stuff, and lots of practical stuff as well. That?s her in the red and? white striped shirt. The shower was about 45 miles away from my house. I haven?t been very social lately, but this is something that I couldn?t miss, you know, I couldn?t not go. So we made the trip, I hung out with the girls for about three hours, then went back home. I spent the entire next day in my recliner recuperating.

On December 19, I had my first appointment with the new gastroenterologist. He seems to be ok as far as doctors go. I hand carried my records from Arizona with me to his office, so he would have them that day. He spent a good amount of time reading over them, shaking his head every so often as if he couldn?t believe how I was treated. When I asked him if there was? a medically necessary reason for waiting 13 days to do surgery, he didn?t answer the question.? He did, however, give me an answer when I asked him how long I could expect my pain to last: He said ?It could be a few more months, or it could be forever, we just don?t know.?

He said the pain is probably caused by scar tissue from numerous abdominal surgeries over the course of my life. The main thing I wanted to accomplish from this visit was to establish a doctor-patient relationship, so that if I have any gastrointestinal problems in the future, I can say my doctor is Dr. XXXX. The secondary goal was to get another RX for pain meds so I don?t run out. He wrote the prescription for me and told me to continue taking it as I have been, and if anything changes to call him. I have another appointment in four months. And yes, he says I am healing as expected, as far as the incision goes, and there is nothing to worry about there. And yes, the pain I am experiencing is also considered normal in my circumstances, so it is also not something I should worry about. At least that much of my worries have been relieved by going to this doctor.

Next, on December 20 I had an appointment with the M.D. who is associated with the mental health clinic. The did an extensive, intensive interview that included many many questions about my medical, mental, and emotional background. It was THE most in depth doctor interview I have ever had, and that in itself makes me feel a lot better about going to them, because they ARE taking the time to ask me what is going on with me, and listening to me when I tell them. I have been to doctors over the years who have acted like I was a pain in their behind to be dealt with in a little time as possible. Not so with this group. At the end of the interview, they decided to leave me on Celexa 40 mg once a day, and gave me a prescription for something to help me sleep. I haven?t had to take it every night, but on the nights when I do need it, it has helped a lot. I have spent many nights laying there all night with my eyes wide open, unable to sleep, unable to stop thinking about the bills, the pain, the fear, the boogey men.

While we were in Rome for the doctor appointment, we saw a Honey Baked Ham store on the way to the office. So, we stopped on the way home to buy a ham for our family Christmas get together.

Our girls, Becky and Emily, and their families, came on Saturday before Christmas for a late lunch. We had the ham, sweet potato casserole, potato salad, and green beans. I made Death By Chocolate for dessert, and Becky brought a pecan pie and a key lime pie. Of course, the best part was the conversation and laughter, sitting around the table with the now grown kids, and just enjoying the day with them.

The next day, Sunday, was spent in the recliner again all day, resting up from the company. Fabgrandpa and I ate ham for breakfast, lunch and dinner for about 4 days. Lots of sandwiches, and plain sliced ham. Christmas day, we didn?t do much. The day after Christmas, my younger brother, who lives in south Georgia, came to see me and my new house. He had been to my mother?s for Christmas, but I just didn?t feel like going. It was so good to see him!

That just about covers it, except that both Fabgrandpa and I are sick with colds. I have been miserable?just blowing my nose or sneezing makes me hurt! My ears feel stopped up, and my throat hurts. If I?m not better by 1/2, I?m going to the urgent care place in Cedartown.

Here are three keys for Texas in the Valero Alamo Bowl.

1. Keep David Ash calm: The sophomore quarterback is going to feel a ton of pressure to perform given that this is basically an audition for next season?s starting position. Ash did not start the regular-season finale due to injury. So the situation is much like last season when he did not start against Baylor but did in the bowl against Cal. However, the stakes have been raised because a Texas loss means the Longhorns would finish with the exact same record from 2011, and that is not the progress many expected from this team.

Ash also is facing a very good pass defense that has proved it can bring pressure from defensive end Scott Crichton, and defensive back Jordan Poyer is second nationally with seven interceptions.

2. Plug the gaps: Oregon State wants to pass before it runs. But given that the Texas defense is so porous against the run game -- 199 rushing yards allowed per game -- the Beavers are likely to get Storm Woods involved early and often. Texas has simplified the defense to help out the linebackers but it needs to have a strong game from Peter Jinkens and Steve Edmond to have any chance of keeping the Beavers in check. Jinkens has proven to be a playmaker who has sideline-to-sideline speed. If his emotions do not get the better of him, he can be a factor. Edmond has trouble reading what is happening but lately has started to come around and is no longer a step slow.

3. Start fast, finish strong: It seems like a pretty simple concept but Texas does have a tendency to start slowly in big games -- Oklahoma comes to mind. Oregon State is the classic Aesop tortoise. The Beavers are plodders and usually are able to catch their opponents in the end. Oregon State won its first three games by less than a score and lost two of its games by a combined six points. So the Beavers are accustomed to playing in close games. And given that they have come back against teams such as Arizona and Arizona State, they are not apt to fold if Texas comes out with a quick onslaught of points. To counteract that, Texas must continue to pressure the Beavers on offense and extend its drives. There might be some hiccups with new playcaller Major Applewhite but Texas will have to overcome those to keep the Beavers at bay.

GOP Senators Introduce Immigration Reform Bill

While discussion of the so-called ?fiscal cliff? has dominated headlines and the attention of the White House, proposals to reform the nation?s immigration laws have been introduced and pushed forward by several Republican leaders on Capitol Hill.

On Nov. 27, 2012, Sens. Jon Kyl, R-Ariz., Kay Bailey Hutchinson, R-Texas, and John McCain, R-Ariz., introduced the Assisting Children and Helping Improve Educational Value for Employment (ACHIEVE) Act. The legislation, if enacted, would offer legal status to eligible undocumented youth who came to the United States as children. The bill (S. 3639) proposes to provide legal status to young undocumented immigrants through a three-step visa process.

?Many young people in this country are here illegally through no fault of their own. Relegating a potentially productive portion of the population to the shadows is neither humane nor good economic or social policy,? Sen. Kyl said in a written statement. ?Only those who have abided by our nation?s laws, while residing within its borders, would be eligible for continued legal status, and there is no automatic path to citizenship.?

In August 2012, President Barack Obama signed an executive order that provides young undocumented immigrants legal status and work permits if they are younger than 30 and came to the United States before age 16. The ACHIEVE Act as introduced by the Republican senators would create a more formalized and regimented system than the process set up by the president?s executive order.

According to the legislation, W-1 visas would be available to the undocumented youths who attend school to earn college or vocational degrees or who agree to serve in the U.S. military for four years. To qualify, applicants must reside in the U.S. five years prior to the bill?s passage and have entered the country before the age of 14. Applicants who have been convicted of a felony would be ineligible to participate in the visa program.

After finishing their education or military service requirements for the W-1, applicants would then become eligible to receive a W-2 work visa that would allow them to work in the United States for four years. Once the four years of work on a W-2 visa were completed, applicants would become eligible for a renewable W-3 work visa; however, no pathway to U.S. citizenship would be available under the ACHIEVE Act proposal.

Sources familiar with the issue say that the Republicans? effort to push forward immigration reform is a response to the 2012 election, when nearly 70 percent of Hispanics voted for President Obama. Many GOP candidates during the election campaign, including presidential candidate Mitt Romney, took a hardline stance on immigration issues. Romney was quoted as saying that all undocumented immigrants should leave the United States by ?self-deportation? and then reapply for legal entry.

According to some political analysts, the reform proposals offered by Republicans during the ?lame duck? session of Congress demonstrate that GOP leaders are softening their stances on immigration issues. On Nov. 30, 2012, the House of Representatives passed the STEM Jobs Act of 2012 (H.R. 6429). If enacted, the proposal would make up to 55,000 visas available to qualified immigrants who have advanced degrees in science, technology, engineering, or mathematics (STEM degrees) from a U.S. university and agree to work for at least five years in the United States in a STEM-related field.

The proposal was approved largely down party lines. Democrats objected to a provision in the bill that would eliminate a visa lottery program that allows workers from various nations and backgrounds to apply for U.S. work visas.

While the ACHIEVE Act and the STEM Jobs Act have strong support among GOP members of Congress, both bills face an uphill battle in the Senate, which is controlled by the Democrats. In addition, the White House has indicated that the president would veto both proposals and instead wants to concentrate on enacting a comprehensive immigration reform package in 2013.

OTTAWA - Canadians will have a little more room to contribute to their Tax Free Savings Accounts as the calendar flips over, but they'll have to wait until the federal budget to see if there will be any more new savings on their taxes.

"Typically when there are new deductions, they announce them in the budget and you get them in that year," said Jason Safar, a tax partner at PwC.

"If it is good news they want to get it out and if it is bad news and you announce it, you might as well implement it because people are angry about it anyway."

And with the federal and provincial governments in deficit slaying mode, Safar said don't get your hopes up for big moves come budget day.

"I haven't heard any rumblings of any significant changes," he said.

For the very wealthy in Ontario though, the new year brings bad news from the tax man ? the top rate for the biggest earners in the province will creep a little higher for those earning more than $500,000.

Jeff Paisley, a senior manager at Deloitte, said those earning more than $500,000 a year saw the top combined federal-provincial marginal rate increase to 47.97 per cent from 46.41 this year.

The rate goes up again on Jan. 1, 2013 to 49.53 per cent, he said.

"So, that's a bit of an increase," Paisely said. "Does the average Canadian get hit by this? I wouldn't say so."

And in Quebec, the marginal tax rate will also edge up, though it kicks in at just $100,000.

"The highest marginal rate in Quebec for 2012 was 48.22 per cent and now the highest marginal rate in Quebec as of Jan. 1 is going to increase to 49.97 per cent," Paisely said.

The TFSA account contribution limit is going up from $5,000 a year ago to $5,500 for 2013.

Canadians will also see certain income tax and benefit amounts increase two per cent for inflation.

The federal tax bracket thresholds will all increase by two per cent, with the top bracket of 29 per cent not kicking in until taxable income of $135,054 for 2013, up from $132,406 for 2012.

Amounts for several non-refundable tax credits also increase, including the basic personal amount which will stand at $11,038, up from $10,822.

In Ontario, seniors and those who live with them will also be able to take full advantage of the Healthy Homes Renovation Tax Credit that allows people to claim up to $10,000 worth of eligible home improvements that was announced late in 2012.

"Unless someone had a renovation that they were planning to do, they weren't going to squeeze that in," Safar said of the measure which could save Ontarians up to $1,500.

No deal in sight as deadline for fiscal deal nears

WASHINGTON (AP) ? Lawmakers are engaged in a playground game of "who goes first," daring each political party to let the year end without resolving a Jan. 1 confluence of higher taxes and deep spending cuts that could rattle a recovering, but-still-fragile economy.

President Barack Obama returns from Hawaii Thursday to this increasingly familiar deadline showdown in the nation's capital, with even a stopgap solution now in doubt.

Adding to the mix of developments pushing toward a "fiscal cliff," Treasury Secretary Timothy Geithner informed Congress on Wednesday that the government was on track to hit its borrowing limit on Monday and that he would take "extraordinary measures as authorized by law" to postpone a government default.

Still, he added, uncertainty over the outcome of negotiations over taxes and spending made it difficult to determine how much time those measures would buy.

In recent days, Obama's aides have been consulting with Senate Democratic Leader Harry Reid's office, but Republicans have not been part of the discussions, suggesting much still needs to be done if a deal, even a small one, were to be struck and passed through Congress by Monday.

At stake are current tax rates that expire on Dec. 31 and revert to the higher rates in place during the administration of President Bill Clinton. All in all, that means $536 billion in tax increases that would touching nearly all Americans. Moreover, the military and other federal departments would have to cut $110 billion in spending.

But while economists have warned about the economic impact of tax hikes and spending cuts of that magnitude, both sides appear to be proceeding as if they have more than just four days left. Indeed, Congress could still act in January in time to retroactively counter the effect on most taxpayers and government agencies, but chances for a large deficit reduction package would likely be put off.

House Republican leaders on Wednesday said they remain ready to negotiate, but urged the Senate to consider or amend a House-passed bill that extends all existing tax rates. In a statement, the leaders said the House would consider whatever the Senate passed. "But the Senate first must act," they said.

Aides said any decision to bring House members back to Washington would be driven by what the Senate does.

Reid's office responded shortly after, insisting that the House act on Senate legislation passed in July that would raise tax rates only on incomes above $200,000 for individuals and $250,000 for couples.

Meanwhile, Obama has been pushing for a variant of that Senate bill that would include an extension of jobless aid and some surgical spending reductions to prevent the steeper and broader spending cuts from kicking in.

For the Senate to act, it would require a commitment from Senate Republican Leader Mitch McConnell not to demand a 60-vote margin to consider the legislation on the Senate floor. McConnell's office says it's too early to make such an assessment because Obama's plan is unclear on whether extended benefits for the unemployed would be paid for with cuts in other programs or on how it would deal with an expiring estate tax, among other issues.

What's more, House Speaker John Boehner would have to let the bill get to the House floor for a vote. Given the calendar, chances of accomplishing that by Dec. 31 were becoming a long shot.

Amid the standoff, Geithner advised Congress on Wednesday that the administration will begin taking action to prevent the government from hitting its borrowing limit. In a letter to congressional leaders, Geithner said accounting measures could save approximately $200 billion.

That could keep the government from reaching the debt limit for about two months. But if Congress and the White House don't agree on how to avoid the "fiscal cliff," he said, the amount of time before the government hits its borrowing limit is more uncertain.

"If left unresolved, the expiring tax provisions and automatic spending cuts, as well as the attendant delays in filing of tax returns, would have the effect of adding some additional time to the duration of the extraordinary measures," he wrote.

Whenever the debt ceiling hits, however, it is likely to set up yet another deadline for one more budget fight between the White House and congressional Republicans.

Initially, clearing the way for a higher debt ceiling was supposed to be part of a large deal aimed at reducing deficits by more than $2 trillion over 10 years with a mix of tax increases and spending cuts, including reductions in health programs like Medicare. But chances for that bargain fizzled last week when conservatives sank Boehner's legislation to only let tax increases affect taxpayers with earnings of $1 million or more.

Obama and his aides have said they would refuse to let Republicans leverage spending cuts in return for raising the debt ceiling. But Republicans say the threat of voting against an increase in the limit is one of the best ways to win deficit reduction measures.

Another potential showdown is pending. A renewed clash over spending could come in late March; spending authority for much of the government expires on March 27.
